A problemática da eficácia do princípio da dignidade da pessoa humana na afirmação dos direitos sociais à educação, ao trabalho e à segurança de cidadãos LGBTI na cidade Bagé-RS

Abstract

The LGBTI (Lesbian, Gay, Bisexual, Transgender and Intersex) citizens have considerable difficulty in asserting their fundamental rights in Brazil, despite the dignity of the human person being the backbone of the Federal Constitution of 1988. Regarding this, this paper analyzes the problem the effectiveness of the principle of the dignity of the human person in affirming social rights to education, work and security of LGBTI citizens in the city of Bagé, Rio Grande do Sul. The general objective of the work is to make an analysis of this effectiveness through an empirical research with LGBTI citizens from the Bagé, who will answer questions about the affirmation of their social rights to education, work and security, using their perception to construct an effective graduation of the aforementioned principle. Considering the supposed positive reality of the city of Bagé related to the affirmation of fundamental rights of LGBTIs, due to the two precursory judicial decisions in the country about the matter, it arises the relevance of the investigation to prove the existence or not of this positive reality, in order to identifying which factors (social, cultural, legal) can be applied in other regions of the country to affirm the rights surveyed. The method used was the hypothetico-deductive, through the empirical research, with a qualitative approach, embodied in the structured and semi-structured companies with the LGBTI goals of Bagé, supported by the theoretical framework structured in Law, with an interdisciplinary focus in Sociology, Philosophy and Education. Through the results obtained by the research, we verified that the social rights in matter need to be investigated on a case-by-case basis, taking into account the specificities of each group that makes up the LGBTI acronym, not being possible to affirm a full social effectiveness of the principle of the dignity of the human person in the context of the city of Bagé for all these citizens.
