O conselho tutelar e as políticas públicas para crianças e adolescentes em Pelotas / RS.

Abstract

With the redemocratization of the Brazilian State, the Federal Constitution citizen passed, culminating in the proposalto the creation and ampliation of public policies that would provide to the Brazilian population the path to the full citizenship.In this sense, priority was given by the constitutional text to the criation of public policies that would serve a portion of great importance in society: the childhood and youth, arising, in this context, the Child and Adolescent Statue. Together, the Federal Constitution and the Child and Adolescent Statue, regulated the public policies to be created for the full development of children and adolescentes in Brazil, creating organs that supervise and protect them from violations of rights of any kind.The Guardianship Council is between the organs created, being its attribution is to inspect the operation of the municipally and statepublic policies, filtering and guiding cases of assistance to the competent state organ. Besides that, it has the attribution of care for the defense of the rights of children and youth in their totality, and has de obligation to communicate to the judiciary power the occurence of any type of violation. In the context of the assignments of the council, this organ has a diferente and peculiar characteristic over other deliberative councils, the power to execute measures within its legally stipulated competence.In view of this, the presente work, based on a theoretical reference of public policies, subarea of Political Science, aims to know the guardianship council of the municipally of Pelotas/RS, confronting its legal attributions with the materiality of the daily experience of the councl in order to initiate to a research agenda on this subject in the area of Political Science and this thematic.
